Internet Music Services Licence

PPNZ's Internet Music Services Licence is a 1 year renewable licence for individuals or businesses ("Licensee") who have non-interactive webcast activities and whose gross annual income generated from each of the internet services is less than $15,000 per annum.

The Agreement does not cover the copyright in musical works. A separate licence for these rights is required from APRA|AMCOS (www.apra.co.nz).

Non-Interactive webcasting A service where music and/or music videos are communicated without interactive controls to users and no permanent or temporary file is retained by the user.

Effective technologies must be installed which prevent stream ripping/copying

Metadata that identifies tracks and artists to be communicated alongside transmission (but nor prior to transmission).

Licensees must display a PPNZ logo and hyperlink on their site (supplied after licensing).

Available for webcasters based in New Zealand, with users who are also based in New Zealand and/or the territories listed in the Territories Schedule

The following activities are not permitted under the Internet music services licence
  • Providing individual tracks for digital download (except as part of an applicable service listed above).
  • Synchronisation (e.g. inclusion into advertising or promotional material).
  • Manufacturing of CDs, DVD, etc containing music or music videos.
  • Sampling, adaptation, parody or mockery.
  • Any activity that can be considered insulting or detrimental to any recording artist(s).
  • The continuous use of artists and tracks, i.e. in any 3 hour period you are not permitted to use:
    • More than 3 songs from a particular album (including no more than 2 consecutively); and
    • More than 4 songs from a particular recording artist or from any compilation of tracks (including no more than 3 consecutively).
  • The transmission of unauthorised recordings e.g. bootlegs or sound recordings that have not yet been made available in the webcaster's territory.
  • The use of controls that enable the user to pause, skip, move forward or backwards through the stream.
  • Allowing personalisation of the service by users to dictate the tracks that are provided to them.
  • Providing advance notice of tracks or albums that will be played, other than the introduction of the next track e.g.by a DJ
  • Providing the ability for users to scan transmissions in order to select and/or copy a particular music track or music video.
  • Continuous programming of less than 3 hours duration
  • Archival programming of less than 5 hours duration, or if the archived programme is greater than 5 hours duration, then not made available for more than 2 weeks.
