Copyright clearances

The use of a sound or video recording must be cleared first with the copyright owner(s) if you wish to use it in any of the following areas:

  • Commercials, Film and Documentary soundtracks

  • Broadcast (radio, TV, internet) of productions or commercials containing music

  • Retail Video/DVD/CD

  • Non-Broadcast/Retail Video/DVD/CD (eg. Production runs of  weddings, functions, events, etc)

  • Audio Visual presentations

  • Dance/Play/Opera productions

  • Fashion runway shows productions

  • Featured entertainment for sports events

    … or any other situation where music can enhance or give an ambient feature.


    The fee for copyright clearances must be negotiated with individual copyright owners. A list of copyright owners is listed below.  If you do not know or are unsure who the owner is PPNZ is able to identify copyright owners for you.     Is this the only permission I need to obtain?

  • No, you will need obtain clearances from the composers as well. This is represented in New Zealand by APRA/AMCOS ( www.apra.co.nz ).

     

    What factors dictate the time it takes to get tracks cleared and the royalty fee charged?

    The artists’ profile, how much of the recording is used, how the recording is used, whether the recording is local or international, and how many recordings are requested for a project all impact on clearances. Due to these factors, clearances can take up to 6 weeks or sometimes longer.


    Which type of music is easiest to clear?

    New Zealand music is often the quickest to clear as most recording owners are in the country and are generally easier to contact.


    Which recordings will not get clearance?

    Some artists and labels are very protective or place a high value on particular sound recordings. Some labels / artists do not allow their work to be used under any circumstances. This is their right to do so. For example:

    Artists for which clearance will not be given:

    The Beatles, Guns 'n' Roses, Karajan, Pink Floyd, Queen, The Rolling Stones, Tool, Vangelis.

    Artists for which large clearance fees  will be required (approx. US$10,000 - $100,000+):

    Elton John, Elvis Presley, Frank Sinatra, John Williams, Radiohead, Roger Whittaker, Smashing Pumpkins.

    Artists for which clearance is difficult to obtain:

    The Carpenters, Bryan Adams, Darcy Clay, Metallica, U2.

    Artists for which clearance will only be given with special instructions:

    Dionne Warwick & Elton John “That’s what friends are for” - may only be used for AIDS-related charities.
